TERMS AND CONDITIONS OF BOOKING AND OPERATION – FIBAGU SAC (ANDEANDO PERU)
Dear Traveler, thank you for choosing us and for your trust. We kindly ask you to read the following information carefully. The tourism service system in Peru—specifically in the Ancash region and the Cordillera Blanca range—is governed by government and operational regulations that may differ from those in your home country.
1. DEFINITIONS AND LEGAL FRAMEWORK
The booking of any service offered by FIBAGU SAC through its physical platforms or its official website www.andeandoperu.com is governed by these Terms and Conditions. THE CUSTOMER and THE AGENCY expressly submit to these clauses.

THE AGENCY: Refers to FIBAGU SAC, RUC 1234567890, a local travel agency and tour operator registered in Huaraz, Peru. THE AGENCY acts as a direct operator for trekking, mountaineering, and conventional tours, and as an organized intermediary for third-party services such as hotels and inter-provincial transportation.

THE CUSTOMER: The individual or legal entity purchasing any service. In the case of minors, parents or legal guardians assume full responsibility for all acts and expenses incurred.

THE SERVICE: The logistical and operational organization of tours, including ground transportation, accommodation, mountain meals, entrance fees (Sernanp), professional guiding, and other items detailed in the itinerary.

TACIT ACCEPTANCE: The act of making the 50% booking deposit payment constitutes immediate, total, and irrevocable acceptance of these terms, serving as a binding electronic signature.
2. BOOKING, PAYMENTS, AND DEADLINES

Booking and Management Deposit (50%): To guarantee and confirm any service, THE AGENCY must receive an advance payment of 50% of the total cost.

Non-Refundable Nature of the Deposit: THE CUSTOMER accepts that this payment is 100% NON-REFUNDABLE and NON-TRANSFERABLE. This amount is immediately used by THE AGENCY for administrative management and essential pre-operational logistics (securing UIAGM/AGMP mountain guides, purchasing provisions, booking private transportation, and permits) which, due to the nature of expeditions in Huaraz, do not allow for refunds.

Outstanding Balance (Remaining 50%): THE CUSTOMER may pay the total balance of the tour at any time prior to arrival. However, the mandatory deadline to pay the balance is 48 hours before the start of the tour for the payment to be verified in our accounts.

Failure to Pay: If the payment is not verified within the established deadline, THE AGENCY reserves the right to cancel the reservation due to breach of contract, and the initial deposit will be forfeited without the right to a refund.

Transaction Fees: All fees derived from the payment method—including banks, PayPal, Visa, Mastercard, Western Union, or international wire transfers—must be fully covered by THE CUSTOMER.
3. CANCELLATION POLICY AND “ASSET DELIVERY” SOLUTION

Cancellation by the Customer: If THE CUSTOMER cancels the reservation after having paid 100% of the tour, NO CASH REFUND WILL BE PROVIDED.

Legal “Asset Delivery” Solution: In lieu of a cash refund, THE AGENCY will fulfill its responsibility by delivering to THE CUSTOMER only the entrance tickets (such as those for the Huascarán National Park), hotel vouchers, or other documents that strictly correspond to the confirmed and paid reservation issued in the passenger’s name.

Operational Release: Once these assets are delivered, THE AGENCY is released from all operational responsibility, including guide services, camp logistics, pack animals, private transportation, and meals, which are non-refundable as they have already been booked and accrued.

No Show: Failure to arrive at the scheduled time, a “no-show,” or lack of original documents such as a passport or ID will result in the loss of 100% of the service value without the right to a refund.
4. FORCE MAJEURE AND CONTINGENCY PROTOCOLS
Force Majeure is defined as unpredictable and unavoidable events such as earthquakes, floods, landslides/avalanches (common in glacial zones), extreme weather conditions that prevent climbing or transit, strikes, roadblocks (specifically on the Pativilca-Huaraz route or the Callejón de Huaylas), civil unrest, or government shutdowns of national parks.

Ticket Management: If the National Service of Natural Areas Protected by the State (SERNANP) or other authorities formally authorize date changes due to the contingency, THE AGENCY will facilitate this management for THE CUSTOMER.

Limitation of Liability: If the authorities do not authorize a change or refund, THE AGENCY is not obligated to provide new tickets. THE CUSTOMER must pay for new entrance fees if they wish to reschedule.

Extra Expenses: THE AGENCY does not assume costs for additional hotel nights, flight changes, or extra transportation resulting from Force Majeure events.
5. HUASCARÁN NATIONAL PARK AND DISCOUNTS

Entry Regulations: Entry to the Huascarán National Park (PNH) is subject to the current rates and regulations of SERNANP. Tickets are personal and non-transferable.

Student Discount: Requires a copy of a valid University ID to be sent at the time of booking and the presentation of the original physical card at the entrance control. Without the original physical card, the discount will be forfeited without liability to THE AGENCY.
6. PHYSICAL CONDITION, HEALTH, AND ACCLIMATIZATION

Acclimatization: Huaraz is located at 10,013 ft (3,052 m). It is highly recommended to arrive in the city 48 to 72 hours before starting high-effort activities (such as Santa Cruz Trek, Laguna 69, or mountain summits). THE AGENCY is not responsible for altitude sickness (soroche) or related health complications.

Authority during the Trip: THE AGENCY reserves the right to remove any person from a tour or expedition who puts their own integrity or that of the group at risk due to lack of physical capacity, lack of proper personal gear, or inappropriate conduct, without the right to a refund.
7. SERVICE STANDARDS AND ACCOMMODATION

Regional Categorization: THE CUSTOMER accepts that standards in rural areas of Ancash may differ from those in their home country. Mountain refuges and local homestays are rustic and part of an adventure and cultural experience.

Third Parties: Inter-provincial bus services and external hotels are subject to their own terms and conditions.
8. TRAVEL INSURANCE, ASSISTANCE, AND EMERGENCIES

Insurance Recommendation: THE AGENCY considers it mandatory/highly recommended to purchase a comprehensive travel insurance policy that includes coverage for adventure sports, mountain rescue, and aero-medical evacuation.

Commitment to Assistance: Our staff (AGMP/UIAGM guides) is trained in wilderness first aid. We provide logistical support, such as a first aid kit and coordination of local evacuation to the nearest health facility in the event of an emergency.

Limits of Assistance: This support is subject to the geographical (remote areas of the Cordillera Blanca), weather, and social limitations of the region. THE AGENCY does not guarantee response times for external government or rescue services (High Mountain Police).

Financial Exoneration: THE AGENCY will not assume the financial costs of emergencies, including clinics, hospitalization, medication, emergency transport, or repatriation. These expenses must be covered by THE CUSTOMER or their insurance provider.
9. PRIVACY, IMAGE RIGHTS, AND JURISDICTION

Chargeback Waiver: THE CUSTOMER agrees not to initiate chargeback processes with their bank regarding the initial deposit, acknowledging that this amount has already been executed for non-refundable logistics and purchases in their name.

Rights of Image: THE AGENCY may use audiovisual material captured during the tour for marketing and promotional purposes on www.andeandoperu.com and social media, unless expressly prohibited in writing.

Jurisdiction: Any legal dispute shall be submitted exclusively to the courts of the city of Huaraz, Ancash, Peru, under Peruvian legislation.
10. MODIFICATION OF TERMS AND VALIDITY
FIBAGU SAC (ANDEANDO PERU) reserves the right to update or modify these Terms and Conditions at any time to optimize operations or adapt to new legal frameworks. However, for each specific booking, the terms in effect on the exact date the booking deposit (50%) was confirmed shall apply.
